Adam Smith said that ‘the propensity to truck, barter and exchange one thing for another is common to all men, and to be found in no other race of animals.’ Smith addressed the mark of the man economical, and there is no denying that this is the peculiar way he acts: clearly, to truck, barter and exchange is to act in a certain way. Austrian economics adopts this way of looking at the realm of economics. It prides itself as a (...) theory of human action. This claim seems ill-founded as long as so important a contribution as Ludwig von Mises’s praxeology remains insufficiently understood. In this paper, I address Barry Smith’s charge that in praxeology ‘other core notions, in addition to the concept of action, have been smuggled into and the theory is therefore not purely analytic’. I offer logical proofs of two cornerstone theorems of praxeology, the uneasiness theorem and the scarcity theorem, and thus provide vindication. Also, the findings support Mises’s controversial claim that economics is a priori founded in action theory. Thus, Carl Menger’s dream to lay foundations to economics and the other social sciences may have come true in the guise of praxeology. (shrink)

The theory of the just price is commonly assumed to have three sources: Political philosophy of Greek antiquity, scholastic ethics of the High Middle Ages, and the Roman law of obligations of late antiquity. While closer inspection confirms this holds for the first two worlds of thought the latter assumption seems ultimately unfounded. The paper claims that the evidence notoriously presented on behalf of that assumption – two rescripts attributed to Roman emperor Diocletian, namely Codex Iustinianus 4.44.2 and 4.44.8 – (...) ultimately points in another direction. Offering both an analysis and an alternative reading of the rescripts an integrated interpretation is given that reconciles them with the “liberalistic spirit of Roman law”. Also, it is explained why, from the point of view of legal and social philosophy, the fact that Roman law refrains from introducing a moral aspect to the institute of price fixing speaks in favour of Roman law rather than against it. Moral subjectivism is commonly associated with out-of-favour theories like, e.g., Alfred Ayer’s emotivism or John Mackie’s error theory. This paper approaches the field against the background of the attitudinal character of morality and religion. The possibility of a brand of moral subjectivism is established which is common to Ayer’s and Mackie’s theories in name only yet still has significant merits. The perspective from action theory and the philosophy of mind suggests that the problem of moral obligation, central to moral philosophy, (...) is more convincingly dealt with by subjectivism than by its rivals: In contrast to realism or even relativism (with which subjectivism is often confused), subjectivism can help to explain the peculiarities of obligation without forcing us to disregard the parallel problem in the field of religion. This finding calls into question the rationale for, as well as the success of, central assumptions in ontology and semantics which the realist so freely hands out in order to make his point: If religious facts and the truth-aptness of religious judgements will not explain religious obligation, moral facts and the truth-aptness of moral judgements will not help the moral realist either. So unless we do not wish to simply cast the problem of moral obligation aside, in future, moral subjectivism must be seriously considered as a worthwhile position in its own right. What is discrimination and what makes wrongful discrimination wrong? Even after an ever-rising tide of research over the course of the past twenty-five or so years these questions still remain hard to answer. Exercising candid and self-critical hindsight, Larry Alexander, who contributed his fair share to this tide, thus remarked: “All cases of discrimination, if wrongful, are wrongful either because of their quite contingent consequences or perhaps because they are breaches of promises or fiduciary duties.” If this is true it (...) raises serious doubts as to how wrongful discrimination can be a moral wrong in itself. Also, the question comes up as to who it is who breaches a promise or a fiduciary duty. This paper defends the view that the substance of these remarks is better understood by couching them in a political approach towards discrimination. Against this background, they give rise to real and pressing concerns. Once we conceptualise the realm political along Hobbesian lines as the battleground comprising both the private sphere of the individual and the public sphere of the commonwealth it emerges that discrimination has different significance with regard to these respective spheres. In order to illustrate this, I adopt Kasper Lippert-Rasmussen’s descriptive account of discrimination as „differential treatment on the basis of membership of a socially salient group“ and the common view that wrongful discrimination is wrong because it is harmful, disrespectful, or both. In the private sphere the case can be made for morally permissible cases of discrimination. Sexual discrimination due to sexual self-determination with consequently freely choosing your sexual or romantic partner is the central case in point. Where somebody feels unfairly rejected and consequently hurt neither the charge of harm inflicted nor that of disrespect endured need be justified. No “breach of promises or fiduciary duties” is involved. The case is different, however, when it comes to the fiduciary of power. In discriminating, he who exercises the power of the commonwealth necessarily breaches a promise and a fiduciary duty. Discrimination thus appears to be more of a problem of political philosophy than one of applied ethics. The paper unfolds a non-modal problem for (moderate) meta-linguistic descriptivism, the thesis that the meaning of a proper name (e.g. ‘Aristotle’) is given by a meta-linguistic description of a certain type (e.g. ‘the bearer of “Aristotle”’). According to this theory, if ⌜α⌝ is a proper name, it is a sufficient condition for the name’s being significant that the description ⌜the bearer of ⌜α⌝⌝ is significant. However, a quotational expression may be significant even when the expression quoted is not. Therefore, proper (...) names and their corresponding descriptions cannot be synonymous, and the corresponding descriptions cannot be viewed as giving the meanings of proper names. So, even if it was immune to Kripke-style modal criticisms, moderate meta-linguistic descriptivism would still seem to founder on the rocks of the opacity of quotation. (shrink)

According to the received account of guilt in the philosophical literature, one cannot feel guilt unless one takes oneself to have done something morally wrong. But ordinary people feel guilt in many cases in which they do not take themselves to have done anything morally wrong. In this paper, I focus on one kind of guilt without perceived wrongdoing, guilt about being merely causally responsible for a bad state-of-affairs. Machine learning algorithms pervade contemporary society. They are integral to social institutions, inform processes of governance, and animate the mundane technologies of daily life. Consistently, the outcomes of machine learning reflect, reproduce, and amplify structural inequalities. The field of fair machine learning has emerged in response, developing mathematical techniques that increase fairness based on anti-classification, classification parity, and calibration standards. In practice, these computational correctives invariably fall short, operating from an algorithmic idealism that does not, and cannot, address systemic, Intersectional (...) stratifications. Taking present fair machine learning methods as our point of departure, we suggest instead the notion and practice of algorithmic reparation. Rooted in theories of Intersectionality, reparative algorithms name, unmask, and undo allocative and representational harms as they materialize in sociotechnical form. We propose algorithmic reparation as a foundation for building, evaluating, adjusting, and when necessary, omitting and eradicating machine learning systems. (shrink)

Our aim in this paper is to present the distinct ways in which Wolff, Baumgarten, and Kant understand the relationship between necessitation, constraint, and reluctant action in an effort to illustrate the subtle ways in which their conceptions of obligation differ from each another. Whereas Wolff conceives of natural or moral obligation as incompatible with constraint, Baumgarten holds that constraint and reluctant action are, in some instances, compatible with natural obligation. Kant departs from Baumgarten by conceiving of obligation as necessarily (...) involving constraint: as Kant’s reply to Schiller’s famous objection reveals, obligation must take on the character of constraint to reluctant action on account of the fact that human beings possess inclinations that always threaten to impel them in directions that oppose morality. Commentators disagree about the extent to which Kant’s ethics is compatible with consequentialism. A question that has not yet been asked is whether Kant had a view of his own regarding the fundamental difference between his ethical theory and a broadly consequentialist one. In this paper I argue that Kant does have such a view. I illustrate this by discussing his response to a well-known objection to his moral theory, namely that Kant offers an implicitly consequentialist theory of moral appraisal. (...) This objection was most famously raised by Mill and Schopenhauer, but also during Kant’s time by Pistorius and Tittel. I show that Kant’s response to this objection in the second Critique illustrates that he sees the fundamental difference between his moral theory and a broadly consequentialist one to be one that concerns methodology. O objetivo do artigo é analisar as aparições do termo contemplação na parte IV da Ética de Espinosa, destacando a relação deste conceito com a questão da medida dos afetos. Mostrando que os afetos têm, ontologicamente, a mesma natureza da imaginação, veremos que a intensidade dos afetos dependerá do “grau de afirmação de presença” que a imaginação correspondente contém. A razão, que também é afetiva em Espinosa, difere dos outros afetos na medida em que não pode ter excesso.

Common knowledge is ubiquitous in our lives and yet there remains considerable uncertainty about how to model or understand it. Standard analyses of common knowledge end up being challenged by either regress or circularity which then give rise to well-known paradoxes of practical reasoning, such as the Two Generals’ Paradox. This paper argues that the nature and utility of common knowledge can be illuminated by appeal to Wittgenstein’s Hinge Epistemology. It is argued that those things that we standardly think of (...) as being common knowledge in our lives are the same as those that Wittgenstein identified as hinge certainties. This identification of common knowledge with hinge certainties allows us to resolve the regress problem for common knowledge and explain how the Two Generals’ Paradox arises. (shrink)

This article presents a parametrized functional interpretation. Depending on the choice of two parameters one obtains well-known functional interpretations such as Gödel's Dialectica interpretation, Diller-Nahm's variant of the Dialectica interpretation, Kohlenbach's monotone interpretations, Kreisel's modified realizability, and Stein's family of functional interpretations. A functional interpretation consists of a formula interpretation and a soundness proof. I show that all these interpretations differ only on two design choices: first, on the number of counterexamples for A which became witnesses for ¬A when defining (...) the formula interpretation and, second, the inductive information about the witnesses of A which is considered in the proof of soundness. Sufficient conditions on the parameters are also given which ensure the soundness of the resulting functional interpretation. The relation between the parametrized interpretation and the recent bounded functional interpretation is also discussed. (shrink)

Telling a patient that the outcome of his illness is not good, or even hopeless, requires sensitivity and the ability to communicate with him in the setting of a hospital which is an unnatural environment divorced from family and friends. It is a task which must be taught and learned by doctors and nurses.

What is the relation between small-scale collaborative plans and the execution of those plans within interactive contexts? I argue here that joint attention has a key role in explaining how shared plans and shared intentions are executed in interactive contexts. Within singular action, attention plays the functional role of enabling intentional action to be guided by a prior intention. Within interactive joint action, it is joint attention, I argue, that plays a similar functional role of enabling the agents to act (...) in a collaborative way such that their actions are rationally guided by a prior shared intention. This understanding of joint attention – as having a key functional role of enabling the rational guidance of joint intentional action by a prior shared intention – allows for an alternative understanding of the kind of minimal cooperation that infants can engage in. On this understanding, infants’ capacity to engage in joint actions is already an incipient capacity to engage in rational and intentional joint actions, albeit a capacity that is necessarily scaffolded by an adult rational co-partner. Resumen En este trabajo se analizan las pautas de elección entre los cuatro paradigmas gramaticales de segunda persona del español peninsular (los prototípicos, representados por los pronombres tú y vosotros, y los desplazados, por usted y ustedes), cuando se usan para indexar a interlocutores específicos, en un corpus de discurso radiofónico de la ciudad española de Salamanca. Se plantea la hipótesis de que los fundamentos cognitivos de las personas gramaticales se proyectan en su potencial sociopragmático como recursos para la configuración (...) de identidades contextuales. Tras clasificar a los participantes del corpus en cuatro tipos de identidad socioprofesional recurrentes en la comunicación radiofónica (locutores, personajes públicos, políticos y hablantes particulares), se calculan las frecuencias con que cada tipo dirige y recibe cada tratamiento de segunda persona. El análisis cuantitativo constituye un punto de partida para la observación cualitativa de los contextos de uso. Tras este se concluye que la elección entre las cuatro formas de segunda persona combina los parámetros sociopragmáticos de cercanía-distancia (que afecta a la elección entre formas prototípicas y desplazadas) e individualidad-grupalidad (que afecta a la elección entre formas singulares y plurales). Tales parámetros remiten, a su vez, al continuum discursivo-cognitivo entre la subjetividad y la objetividad. (shrink)

The purpose of this article is to analyze Spanish first-person plural subjects as a cognitively grounded grammatical choice serving various discursive functions. Both the expressed and omitted variants of the subject will be considered, even if omission is by far the more frequent choice in Spanish and the more communicatively versatile one. The particularly vague reference of omitted nosotros ‘we’ – always involving an extension of the self towards a wider notional scope – results in a remarkable variety of possible (...) contextual projections. It can be used to signal speaker identities as well as manage interpersonal relationships through the iconic suggestion of viewpoint coincidence. First-person plural clauses are quantitatively and qualitatively investigated across two corpora of contemporary Spanish comprising a variety of spoken and written genres. It is found that, aside from the basic distinction between hearer-exclusive and hearer-inclusive first persons, a third, intermediate variant can be considered, that of empathic hearer-exclusive uses. These are typical of interactions where involvement of the audience is sought even if they are not referentially included in the subject, as is usual in some varieties of spoken mass-media discourse. Each one of the referential variants is used with different frequencies and contextual repercussions, depending on the socio-functional demands and goals of particular textual genres. (shrink)
